Kyber Mortgage Corporation dba HyperSmart Home Loans is committed to protecting your privacy, whether in electronic or physical format. This Privacy Policy governs the manner in which Kyber Mortgage Corporation collects, uses, maintains and discloses information collected from you.

Personal Identification Information

We may collect personal information from you in a variety of ways, which may include:

  • Identifying information, such as name, address, telephone number, email address, and Social Security number

  • Employment and income information
  • Bank account balances and payment history

You provide most of this information directly, through our forms or during the loan process. We also collect limited technical information automatically, such as device and usage data, to operate and improve our website. Nonpublic Personal Information

We may collect nonpublic personal information on applications and other forms you complete, through conversations you may have with our loan originators and processors, with our other representatives, and in some cases, over our website. We may also collect information from a wide range of other sources in order to process and/or underwrite your loan. These sources may include among others, employers, attorneys, banks, title insurers, insurance companies and credit reporting agencies.

We do not disclose any nonpublic personal information about our customers or former customers to anyone, except as permitted by law.

How We Use Your Information

We collect information about you to help us serve your financial needs, to provide you with quality products and services and to fulfill legal and regulatory requirements. We use your personal information to verify your identity, detect and prevent fraud, communicate with you regarding our products or services in which you may be interested, respond to your inquiries or requests and/or comply with law enforcement requirements or other legal processes. We also use it to evaluate loan applications and to comply with legal and regulatory obligations.

We may continue to share your information when you are no longer a customer of Kyber Mortgage Corporation.

We do not sell your personal information for money.

Advertising and How We Share Information

We use advertising services from Meta Platforms to measure the performance of our advertising and to show relevant ads to people who have visited our site (retargeting). To do this, we share certain information with Meta both from your browser (through the Meta pixel) and directly from our servers (through Meta's Conversions API). The information shared can include a hashed (irreversible) version of contact details you submit, such as your email address and phone number, along with event information such as the page you were on and the action you took, and online identifiers associated with your device.

We do not sell your personal information for money. However, our use of these advertising technologies may be considered "sharing" of personal information for cross-context behavioral advertising under certain state privacy laws, including the California Consumer Privacy Act as amended.

Non-Sharing Clause

The advertising sharing described in the section above covers website event data and hashed contact details. It does not cover text messaging opt-in data or consent, which are never shared with anyone for any purpose:

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We maintain administrative, technical, and physical safeguards designed to protect your information against unauthorized access, use, or disclosure.

We restrict access to nonpublic personal information about you to those employees who need to know that information to provide products and services to you. Your right to opt out of sharing for advertising. You have the right to opt out of the sharing of your personal information for cross-context behavioral advertising. You can opt out by declining marketing cookies in our cookie banner, and by using recognized opt-out preference signals such as Global Privacy Control. When you have not granted marketing consent, we apply Meta's Limited Data Use setting. Do Not Track and Opt-Out Preference Signals

California law requires website operators to disclose how they respond to browser "do not track" signals. There is no common standard for those signals and they carry no legal effect distinct from recognized opt-out preference signals, so we do not act on them separately. We do recognize the Global Privacy Control and treat it as the operative opt-out preference signal. When we detect Global Privacy Control in your browser, we treat it as a request to opt out of the sharing of your personal information for cross-context behavioral advertising for that browser.

As a mortgage lender, HyperSmart Home Loans is a financial institution under the Gramm-Leach-Bliley Act. Our handling of the nonpublic personal information you provide during the loan process is described in our Financial Privacy Notice, which we provide at application and which is available on request. The advertising technologies described in this policy are used for website marketing and do not use the nonpublic personal information collected during a loan application.
